1. Object

Quavy SAS (hereinafter, "Quavy") publishes a video creation and sharing platform accessible on a website at www.quavy.app, intended to (i) allow Twitch streamers to create content from their channel and share it on their various social networks (hereinafter, the "Platform").

The purpose of these Terms of Use is to govern the access and use of the Platform. We invite you to read them carefully. You understand and acknowledge that Quavy is not a party to any agreement, contract or contractual relationship of any kind between the social networks.

By clicking on the "Connect with Twitch" or "Sign up with email" button, you acknowledge that you have read and agree to all of these terms and conditions of use.

2. Registration to the Platform and Account creation

The use of the Platform is reserved to persons having a Twitch account.

The Platform allows Users to retrieve their Twitch content, edit it and share it on different social networks. You can use Quavy even if you don't have an account on the different social networks. However, you will not be able to share your creations on them.

To create your account, you must connect to your Twitch account, via our platform. By using such a feature you understand that Quavy will have access to your Twitch account, and will keep certain information necessary for the proper functioning of Quavy. You can log out of Quavy with your Twitch account at any time, in which case you will lose access to the platform. To register on the Platform, you must have read and accepted these TOU and the privacy policy.

When creating your Account, you agree to provide accurate and truthful personal information and to update it, either through your profile or by notifying Quavy, to ensure its relevance and accuracy throughout your contractual relationship with Quavy.

You are solely responsible for any use made of your Account by a third party, unless and until you expressly notify Quavy of the loss, fraudulent use by a third party or disclosure of your password to a third party.

You agree not to create or use, under your own identity or that of a third party, any Accounts other than the one originally created.

You acknowledge and agree that Quavy reserves the right not to publish or remove any creations whose content it deems to be contrary to these TOU.

Quavy reserves the right to suspend your Account, limit your access to the Services or terminate this TOU in the event that you fail to comply with this TOU.

3. Operation, availability and functionality of the Platform

Quavy will make every effort to keep the Platform accessible 7 days a week, 24 hours a day. Nevertheless, access to the Platform may be temporarily suspended, without prior notice, due to technical maintenance, migration, updates or due to breakdowns or constraints related to the functioning of networks.

Furthermore, Quavy reserves the right to modify or interrupt, at its sole discretion, temporarily or permanently, all or part of the access to the Platform or its functionalities.

4. Modification of the TOU

These TOU express the entire agreement between you and Quavy regarding your use of the Services. Any other document, in particular any mention on the Platform (FAQ, Blog, etc.), is for information purposes only.

Quavy may modify the present TOU in order to adapt to its technological and commercial environment and to comply with the regulations in force. Any modification of the present privacy policy will be published on the Platform with a mention of the date of the update and will be notified to you by Quavy before it comes into force.

5. Youtube api

Quavy uses the YouTube API. As a Quavy user, you agree to be bound by YouTube's terms of use and privacy policy. You can find more information about YouTube's terms here, and about Google's terms here.

You can revoke access to user data from Google at any time via the security settings page at https://security.google.com/settings/security/permissions.
